Apple, Class Want $310 Million iPhone Performance Deal Upheld – Bloomberg Law

Apple Inc. and plaintiffs asked the Ninth Circuit to affirm the approval of a $310 million class settlement resolving allegations that it intentionally diminished the performance of certain iPhone models, saying objections to the deal lack merit.

Plaintiffs filed more than 60 proposed class actions alleging Apple slowed older phones and hindered battery performance through software updates.

The suits were combined in multidistrict litigation before the U.S. District Court for the Northern District of California, which gave the deal final approval in April but cut the plaintiffs’ attorneys’ fee request from nearly $88 million to $80.6 million. Lead plaintiffs were …
